Sonic Healthcare, Aurora Diagnostics, Clinical Pathology Laboratories and Austin Pathology Associates agreed to a $6.4 million class action settlement to resolve claims surrounding a data breach linked to the American Medical Collection Agency (AMCA).
The American Medical Collection Agency settlement benefits individuals who received a notice from Clinical Pathology Laboratories, Sonic Healthcare, Austin Pathology Associates or Aurora Diagnostics informing them that their information was involved in the AMCA data breach.
The American Medical Collection Agency is a third-party debt collector that works with healthcare providers to collect payments from patients. In 2019, the AMCA reported that hackers had accessed its systems and stolen sensitive information from patients of various healthcare providers.
Sonic Healthcare, Aurora Diagnostics, Clinical Pathology Laboratories and Austin Pathology Associates were among the healthcare providers affected by the AMCA data breach. According to a class action lawsuit against the companies, the data breach could have been prevented if the companies had taken reasonable measures to protect patient data.
The plaintiffs in the case say the defendants failed to protect their data and are responsible for the consequences of the data breach, including the risk of fraud and identity theft.
The defendants have not admitted any wrongdoing but agreed to a $6,438,578.20 class action settlement to resolve the allegations.
Under the terms of the American Medical Collection Agency data breach settlement, class members can receive a cash payment.
Class members who experienced out-of-pocket losses as a result of the data breach can receive up to $5,000 for these losses. This includes unreimbursed expenses, professional service costs, miscellaneous expenses, credit monitoring costs and up to 10 hours of lost time at a rate of $25 per hour.
Class members who did not experience out-of-pocket losses can receive an alternative cash payment of around $50.
All class members can receive two years of free medical and healthcare information monitoring services through CyEx Medical Shield Pro.
The deadline for exclusion and objection is Dec. 3, 2026.
The final approval hearing for the American Medical Collection Agency settlement is scheduled for Jan. 7, 2027.
To receive class action settlement benefits, class members must submit a valid claim form by Jan. 4, 2027.
