What Changed Recently?

Judge Kenneth R. Garrett III of the Circuit Court of Jackson County, Missouri, preliminarily approved the settlement on July 27, 2026, finding probable cause to believe it is fair, reasonable and in the best interests of the class. The order appointed Simpluris as settlement administrator and set the notice program to begin by September 8, 2026, assuming Adams Toyota delivered its class list by August 22, 2026. Notice goes to class members by mail and email, and the settlement website now carries the long-form notice, the court documents and an online claim form.

The case, Foley v. Adams Auto Corp. d/b/a Adams Toyota, No. 2416-CV18198, alleged that Adams Toyota improperly required customers buying vehicles to also buy the ResistAll/EnviroGuard add-on, a product sold with an associated warranty. The petition asserted claims under the Missouri Merchandising Practices Act, the Motor Vehicle Time Sales Act and the Retail Credit Sales Act, along with negligence, negligent misrepresentation and unjust enrichment. In its preliminary approval order the court noted the plaintiff’s allegation that it was company policy to add the product to every vehicle.

Adams Toyota denied all alleged liability and denied that it violated any of the statutes or common law at issue. In the settlement agreement, Adams Toyota makes no admission regarding any claim or defense and maintains that it provides high customer service standards and transparency, and the preliminary approval order states that the agreement is not an admission of any liability, fault or wrongdoing.

Who Qualifies?

The settlement agreement defines the class as customers who received ResistAll/EnviroGuard with their vehicle purchase from Adams Toyota between August 17, 2019, and the final approval hearing. The long-form notice and the claim form state the end of that window as December 7, 2026, while the settlement website’s claim page and FAQ run it to February 11, 2027. The class definition in paragraph 2 of the preliminary approval order gives the start date as August 17, 2021; the agreement, the notice, the claim form and the website all use August 17, 2019.

Each class member belongs to exactly one of three recovery groups, based on the details of the vehicle deal:

  • Recovery Group 1 covers deals in which the ResistAll/EnviroGuard price appears as a separate line item in the deal paperwork, so the amount paid can be read from the documents.
  • Recovery Group 2 covers deals in which the price was not listed as a separate line item, so the amount paid cannot be determined from the paperwork.
  • Recovery Group 3 covers anyone, however the price appeared, who is a current or former Adams Toyota employee; is a family member of a current or former employee and received discounted pricing on the deal; made a claim under the ResistAll/EnviroGuard warranty; or no longer owns the vehicle from the deal for any reason, including resale, trade-in, destruction or repossession.

Anyone who fits a Group 3 category is excluded from Groups 1 and 2. The claim form’s questions on employee status, warranty claims and current ownership are how the administrator places each claimant in a group. When a class member has died, the agreement treats the person’s estate, heirs or representatives as the class member.
