Cosco Fire Protection - Job Postings (Washington) Class Action Settlement Closed You may be included in this settlement if you applied for a job opening with Cosco Fire Protection in Washington between January 1, 2023 and July 26, 2025.
Claim details

An applicant for employment, Shannon Spencer (“Plaintiff” or “Class Representative”), filed a lawsuit against Cosco Fire Protection, Inc. (“Defendant”) on behalf of himself and a class of similarly situated applicants for employment. The lawsuit, Shannon Spencer v. Cosco Fire Protection, Inc. , No. 25-2-21171-1 KNT (the “Lawsuit”) is pending in King County Superior Court before Judge Nikole E. Hecklinger. Plaintiff claimed in the lawsuit that Defendant’s job postings for open positions in Washington did not disclose the wage scale or salary range and/or general description of benefits being offered in violation of Washington law. Defendant disputes Plaintiff’s claims and contends it has not violated any law and that Plaintiff’s claims are without merit.

The Court has not made any determinations regarding the merits of the Plaintiff’s claims, and it has not decided whether Defendant violated the law.

The parties to the lawsuit (the “Parties”) have reached a proposed Class Action Settlement. The settlement includes a total payment by Defendant of $332,000.00 (“Common Fund”). On August 10, 2026, the Court issued an order preliminarily approving the settlement and authorizing the Settlement Administrator, Simpluris, Inc. (“Settlement Administrator”), to issue the Notice .

You are receiving the Notice because Defendant’s records indicate you are eligible to participate in the settlement as a member of the Settlement Class. “Settlement Class Members” include “Plaintiff and all individuals who, from January 1, 2023, through July 26, 2025, applied for a Washington-based job opening with Defendant through a job posting on Defendant’s website or an authorized third-party recruiting channel (Indeed.com), where the job posting did not disclose a wage scale or salary range to be provided to the hired applicant.”

The Court still has to decide whether to approve the settlement. No settlement benefits or payments will be provided unless the Court approves the settlement and it becomes final.

Please read the Notice carefully. Your legal rights are affected regardless of whether you act or do not act. For complete details, please see the Settlement Agreement, the terms of which control, in the documents tab on this site.

Provide/Update Valid Mailing Address

To receive your settlement payment, you must ensure the Settlement Administrator has your updated and valid mailing address. If you request to be excluded, you will no longer be in the Settlement Class and will not receive a settlement payment. This is the only option that allows you to keep any right to sue Defendant about the same legal claims in this Lawsuit. The deadline to request exclusion from the settlement is October 23, 2026 .

Write to the Court explaining why you do not agree with the settlement. You must not exclude yourself from the settlement if you wish to object. The deadline to object is October 23, 2026 .

Employment · Pending — Automatic Payment

Current Status

There is no claim form: class members will be paid automatically if the court gives final approval. King County Superior Court preliminarily approved the $332,000 settlement on August 10, 2026, and the final approval hearing is scheduled for December 18, 2026. The deadline to opt out, object, or update a mailing address or payment choice online is October 23, 2026. No payment date had been announced as of September 29, 2026.

What Changed Recently?

The settlement moved into its notice period after Judge Nikole E. Hecklinger signed the preliminary approval order on August 10, 2026. Notices have gone to class members, and the administrator, Simpluris, has opened the official settlement website with the notice, the settlement agreement, the approval order and the original complaint.

The case, Shannon Spencer v. Cosco Fire Protection, Inc., was filed in July 2025. The named plaintiff alleged that Cosco’s job postings for Washington positions left out the wage scale or salary range and a general description of benefits, which Washington’s Equal Pay and Opportunities Act has required in every job posting by employers with 15 or more employees since January 1, 2023. Cosco denies the claims, says it did not break the law, and admits no wrongdoing by settling. The court has not decided who was right.

Who Qualifies?

The settlement class is everyone who, from January 1, 2023 through July 26, 2025, applied for a Washington-based job opening with Cosco Fire Protection, Inc. through a posting on Cosco’s own website or on Indeed, where the posting did not disclose a wage scale or salary range for the job. Cosco represented in the settlement agreement that 166 people fit that definition.

What counts is where the job was, not where the applicant lived. Applications for openings in other states are not included. Class members were identified from Cosco’s records, and anyone in the class should have received a notice.

How Much Can You Get?

The settlement website estimates each class member’s payment at $1,264.46. Cosco is paying $332,000 in total. Before anything is divided, the fund covers attorneys’ fees of up to $99,600 (about 30%), up to $2,500 in litigation costs, a service award of up to $7,500 for the named plaintiff, and the administrator’s costs, all subject to court approval. What remains is split in equal shares; there are no tiers and no cap.

Treat the figure as an estimate. If the court awards less than the requested fees, costs or service award, the difference goes back into the class fund, and the shares of anyone who opts out are reallocated to everyone else. Either would push individual payments up slightly.

What Proof or Notice ID Is Required?

None to get paid. There is no claim form, and no receipts, pay stubs or application records are needed. The notice includes a LoginID and PIN, which are used only on the settlement website to update a mailing address or switch from a paper check to a digital payment. Keep the notice in case the administrator needs to confirm your identity.

What Is the Deadline?

October 23, 2026 is the deadline for every action in this settlement: requesting exclusion (the letter must be postmarked by that date), filing an objection with the court, and submitting an address update or payment selection online. The notice does not give a time of day or time zone for the online deadline, so it is safest to finish well before the end of the day.

Class members who want to be paid do not need to meet any deadline, as long as the administrator has a mailing address that will reach them.

How Do You Take Action?

To be paid, do nothing, except make sure your mailing address is current. To choose digital payment or update an address, use the Address Update/Payment Selection form on the official Cosco Fire Protection settlement website with the LoginID and PIN from your notice.

What Is This Settlement About?

Equinox, Inc. ("Equinox") has agreed to a class action settlement to resolve claims arising from a data incident it disclosed on or about April 29, 2024. According to the notice, Equinox became aware of suspicious activity and potential unauthorized access to its network, launched an investigation with outside cybersecurity advisors, notified law enforcement, and later determined that cybercriminals may have accessed individuals' private information.

The lawsuits allege that Equinox failed to adequately protect that information. Equinox denies the claims and any wrongdoing, and no court has decided in favor of either side. The two sides agreed to settle to avoid the cost and risk of continued litigation. The cases are McHugh v. Equinox, Inc., Index No. 911677-24, and Carter v. Equinox, Inc., Index No. 901198-25, both in the Supreme Court of the State of New York, Albany County. If you received a notice about this incident, you can file a claim for a cash payment and enroll in credit monitoring.

Who Qualifies?

The Settlement Class includes all living individuals residing in the United States who were sent a notice by Equinox that their private information may have been impacted in the data incident detected on or about April 29, 2024.

Excluded from the class are Equinox, any entity in which it has a controlling interest, and its officers, directors, legal representatives, successors, subsidiaries, and assigns; any judge, justice, or judicial officer presiding over the matter and members of their immediate families and their judicial staff; and anyone who validly opts out of the settlement. If you received a mailed or emailed notice with a Notice ID and Confirmation Code, you have been identified as a class member.

The notice states that the information potentially involved could include names, addresses, dates of birth, Social Security numbers, driver's license numbers, health insurance information, medical treatment or diagnosis information, medication-related information, financial information, provider name, and medical record or patient ID numbers. The exact information varied by individual.

How Much Can You Get?

The settlement offers cash benefits and credit monitoring. A class member can claim the cash benefits and the credit monitoring:

Documented monetary losses — up to $5,000. You can claim reimbursement for unreimbursed out-of-pocket losses fairly traceable to the data incident, up to $5,000 per class member. Examples given in the notice include out-of-pocket credit monitoring costs incurred on or after April 29, 2024, unreimbursed losses from actual fraud or identity theft, and unreimbursed bank fees, long-distance phone charges, postage, or mileage at the IRS business-use rate. This tier requires supporting documentation such as statements or receipts.

Pro rata cash payment — estimated $100. In addition to or instead of documented losses, you can claim a pro rata cash payment estimated at $100. The amount is calculated from the funds remaining in the Settlement Fund after administration costs, attorneys' fees, credit monitoring, and documented-loss payments, divided among eligible claims, and it will be adjusted up or down depending on how many valid claims are filed.

Current Status

Claims are open. Class members have until October 23, 2026 to submit a claim online or mail a claim form postmarked by that date; the notice gives no time of day. The Brevard County Circuit Court has granted preliminary approval, and the final approval hearing is scheduled for November 17, 2026 at 2:15 p.m. by Zoom. No payments have been made, and none will be until the court grants final approval and any appeals are resolved.

What Changed Recently?

The case, Purvis-Wolf v. IR Tiki, LLC d/b/a Pineda Inn Bar & Grill, No. 05-2025-CA-028369, was filed in 2025 in the Circuit Court of the Eighteenth Judicial Circuit in Brevard County. It alleged that the restaurant took Florida’s tip credit on its servers’ and other tipped staff’s pay in a way that left them below the state minimum wage, in violation of the Florida Minimum Wage Act. The parties began settlement talks in January 2026 and signed the settlement agreement in early June 2026. The defendants are IR Tiki, LLC, which does business as Pineda Inn Bar & Grill, and an individual defendant. They deny any wrongdoing, and the court has not ruled on whether the claims have merit.

Judge Patricia Strowbridge conditionally certified the class for settlement purposes, and the administrator emailed each class member a notice with an online claim form. A later agreed order moved the final approval hearing and the notice deadlines tied to it; the dates on this page are the current ones posted on the official settlement website.

Who Qualifies?

The settlement class is tipped staff employed by Pineda Inn Bar & Grill who had a “tip credit” applied to their hourly wage between April 2021 and August 2023 and who were not paid the minimum wage required by the Florida Minimum Wage Act as a result. The settlement agreement says the restaurant’s records show about 81 people in the class, and those people were identified from the defendant’s records and contacted directly.

The class excludes the judge and Florida appellate judges and their immediate families, the released parties, counsel of record, anyone who already released these claims in a separate agreement with the defendant, and anyone who opts out.

What a tip credit is. Florida lets employers count part of a tipped worker’s tips toward the minimum wage. The Florida Constitution fixes that credit at the federal tip credit in effect in 2003, which works out to $3.02 an hour. The employer pays the rest in cash wages, and the tips have to bring the worker up to at least the full minimum wage. Wage lawsuits over tip credits usually allege that the credit was taken for hours or duties it did not lawfully cover; here, the notice describes the claim as a tip credit applied to non-tipped work.

How Much Can You Get?

Each class member who files a valid claim and does not opt out is paid $2.00 for each covered hour worked between April 2021 and August 2023. The notice describes those as hours of non-tipped work; the settlement agreement describes them as hours to which the tip credit was applied. The number of hours comes from the restaurant’s records.

  • Cap: Total payments are capped at $120,000. The agreement bases that figure on 81 class members and raises it by 5% for each class member found above 81.
  • An illustration, not an estimate of any one payment: someone with 500 covered hours would receive $1,000; someone with 1,500 would receive $3,000. Spread evenly across 81 people, the $120,000 cap would average about $1,480 each.
  • Claims-made, with a reversion: only people who file are paid. The defendant deposits money in stages as claims draw it down, and whatever is left after the checks expire, and after any second distribution, goes back to the defendant.

The Notice of Proposed Class Action Settlement and Hearing provides important information regarding your right to participate in or to opt out of a proposed settlement in a putative class action lawsuit (referred to in this notice as the “Settlement”). Named Plaintiff, Raphyr Lubin (“Plaintiff”), filed a lawsuit against Starbucks Corporation (“Defendant”) in the U.S. District Court, Middle District of Florida, Tampa Division. Plaintiff and Defendant are referred to in this notice together as the “Parties.”

Plaintiff alleges in his lawsuit that Defendant provided him and other putative class members with a COBRA Notice that violated the notice requirements of COBRA. Defendant denies the allegations and maintains that the COBRA Notice complied with all applicable laws, but Defendant has agreed to the settlement to avoid the uncertainties and expenses of continuing the case. The judge has not made any determination about who is right or wrong in the case. A summary of the claims asserted in the lawsuit and the proposed Settlement follows.

  • The notice at issue is referred to as a “COBRA Notice,” and the continuation of health insurance coverage after separation of employment is called “COBRA continuation coverage,” after the Consolidated Omnibus Budget Reconciliation Act of 1985. The COBRA Notice is designed to provide former employees who were covered under employer sponsored group health care plans with information and details regarding their right to continue their healthcare coverage and the terms and conditions of that COBRA continuation coverage. 29 U.S.C. § 1166(a) (2), (a)(4), (c). The lawsuit generally alleges Defendant provided Plaintiff and other putative class members with a deficient COBRA Notice. More specifically, Plaintiff asserted that Defendant’s COBRA Notice did not adequately inform him how to exercise his right to elect COBRA continuation coverage in violation of 29 C.F.R. § 2590.606–4(b)(4) et seq . As a result of the alleged violations in the Complaint, Plaintiff sought statutory penalties, injunctive relief, attorneys’ fees, costs and expenses on behalf of himself and all others similarly-situated.
  • Defendant denies that its COBRA Notice was deficient in any manner and denies that it has any liability to Plaintiff or the putative class. Rather, Defendant has asserted that its COBRA Notice complied with any and all relevant laws, including COBRA and the Employee Retirement Income Security Act. Furthermore, had the Parties proceeded in the litigation, Defendant further denies that the matter would have proceeded on a class action basis.
  • At this point in the case, the presiding judge has not made any determination about who is right or wrong. Rather, instead of proceeding with potentially years of litigation with uncertain outcomes, the parties have agreed to resolve the lawsuit through a Court-supervised settlement to avoid further cost and uncertainty. The case has already been pending for six years.
  • The Parties seek to settle this dispute on behalf of Plaintiffs and a “Settlement Class,” which the Parties have agreed to define as follows: “All participants not subject to Starbucks’ Arbitration Agreement, and all beneficiaries in the Defendant’s Welfare Benefits Plan, including the Health Plan and Vision Plan, in the United States who were sent a COBRA notice between July 21, 2016, through January 1, 2023, as a result of a qualifying event, as determined by Defendant and/or its third party administrator and, who did not elect continuation coverage.”
  • Membership in the Settlement Class will be determined based upon Defendant’s records during the Class Period. It is estimated that the Settlement Class is comprised of 33,800 potential members.
  • You received notice of this Settlement by U.S. Mail, which directed you to this website because Defendant’s records indicate that you are a “Settlement Class Member” and eligible to receive payment from this proposed class action settlement.

Data Breach · Claims Open

Current Status

Claims are open. The deadline to file is October 22, 2026, and the Notice states that date without a cutoff time or timezone, so do not assume one. The U.S. District Court for the Northern District of Georgia granted final approval on October 6, 2026, in an order that also awarded attorneys' fees, expenses and service awards. The claim window stays open after approval because the claim deadline falls later than the hearing date. No payment date had been announced as of October 20, 2026; under the Notice, benefits are distributed after final approval and after any appeals are resolved.

What Changed Recently?

The court granted preliminary approval of the settlement in Lamont Bracy, et al. v. Americold Logistics, LLC, Case No. 1:23-cv-05743-TWT, in the U.S. District Court for the Northern District of Georgia, Atlanta Division, and the claim process is now open through the settlement administrator, Kroll Settlement Administration. Americold Realty Trust and Americold Logistics, LLC have agreed to pay $5,250,000 into a settlement fund, and the court granted final approval of the deal on October 6, 2026.

The case reached this point after a contested round of motion practice. On February 19, 2025, Judge Thomas W. Thrash, Jr. ruled on Americold's motion to dismiss, granting it as to four of the counts and denying it as to three, which left part of the case alive and headed toward either trial or a negotiated resolution.

Americold denies all allegations of liability and wrongdoing, and the court has not decided in favor of either side. The Notice states that the parties agreed to settle to avoid the costs and risks of a trial.

Who Qualifies?

The settlement class is all persons in the United States who were notified by Americold that their private information was impacted in the data incidents. In practice, if you received a notice from Americold about either the 2020 incident or the 2023 incident, you are a class member, and the Notice states that Americold's records are what identify you as one.

The people affected were current and former employees and job applicants rather than retail customers, which makes this a narrower class than most consumer data breach settlements. It is nationwide and is not limited to Georgia, even though the case is pending in Atlanta.

Excluded from the class are Americold, any entity in which Americold has a controlling interest, and Americold's officers, directors, legal representatives, successors, subsidiaries and assigns; any judge, justice or judicial officer presiding over the case, along with the members of their immediate families and judicial staff; and anyone who timely and validly opts out.

Two separate cybersecurity incidents are covered. The first occurred on or about November 16, 2020, and the second on or about April 26, 2023. According to the Notice, the private information involved may have included full names, Social Security numbers, addresses, driver's license numbers, state identification numbers, passport numbers, financial account information, health insurance information and medical information. Americold began notifying people about the 2020 incident on or about March 4, 2021 and about the 2023 incident on or about December 8, 2023. The Notice does not state how many people were notified. If you are new to how these cases work, our data breach class action explainer walks through the stages from notice to payment.

How Much Can You Get?

With the settlement approved, Americold pays $5,250,000 into a fund. Court-approved attorneys' fees and expenses, service awards, administration costs and the cost of providing the credit monitoring come out of that fund first, and the balance pays class member benefits. There are three benefits, and the two cash options are described in the Notice as available and/or, so you are not forced to pick just one.

Data Breach · Claims Open

Current Status

Claims are open. The deadline to submit a Claim Form is October 22, 2026, online or postmarked. The deadline to exclude yourself or to object is earlier — October 7, 2026 — so the first decision to make is whether to stay in at all. The court has not yet decided whether to approve the settlement: the Isanti County District Court granted preliminary approval and authorized this notice, and the final approval hearing is set for November 6, 2026 at 9:00 a.m. Central, by Zoom. No payments have been issued and no payment date has been announced; the Notice says benefits are issued only after the settlement is approved and becomes final, and appeals can extend that. If you received a notice with a Notice ID and Confirmation Code, the action to take now is to file before October 22.

What Changed Recently?

The claim window opened after the Isanti County District Court entered an order granting preliminary approval of the class action settlement, which authorized the notice now reaching class members and put the November 6, 2026 final approval hearing on the calendar. That order is posted alongside the Notice, Claim Form and Settlement Agreement on the settlement website's Important Documents page.

The case is Kennedy, et al. v. EFS Advisors, LLC, et al., Case No. 30-cv-24-649, in the Isanti County (Minnesota) District Court. The defendants are EFS Advisors, LLC and Educators Benefit Consultants, LLC, which does business as Aviben. The Notice describes the underlying event as an unauthorized third-party attempt to access the defendants' computer network, detected on or about February 22, 2024, during which the unauthorized actor may have accessed impacted individuals' Private Information.

Worth knowing before you read further: the Notice is unusually sparse about the incident itself. It does not list the categories of data involved and does not state how many people are in the class. For the data categories it points to the Settlement Agreement's definition of Private Information and to the Consolidated Class Action Complaint, both posted on the settlement website. For your own situation, the breach notification letter you received in 2024 is the document that names the specific elements.

The parties disagree over the legal claims. The Notice states that the action has not gone to trial and that the court has not decided in favor of either side; the parties agreed to settle after weighing the risks and uncertainties of continuing to litigate. Nothing in the settlement is a determination that either defendant did anything wrong.

Who Qualifies?

The Settlement Class is defined broadly: all living individuals in the United States whose Private Information was potentially accessed in the Data Security Incident. There is no purchase requirement, no state limitation, and no requirement that you suffered fraud or identity theft.

Three groups are carved out. Excluded from the class are the directors, officers and agents of the defendant; governmental entities; and the judge assigned to the action, that judge's immediate family, and court staff.

Because the class is defined by whose information was in the affected systems rather than by anything you did, the practical test is whether the administrator sent you a notice with a Notice ID and Confirmation Code. Many people in a class like this never had a direct relationship with either company — a benefits administrator typically holds employee information supplied through an employer's plan. If you are unsure whether you are included, the settlement website's contact page is the route to ask.

How Much Can You Get?

Everyone who submits a timely, valid Claim Form may claim two things: one year of three-bureau credit monitoring that includes at least $1,000,000 in identity theft insurance, and one of two cash options. The credit monitoring is not an either-or against the cash — the choice is only between the two cash options.

Claims are open. A claim form must be submitted online or postmarked no later than October 22, 2026. There is an earlier date that is easy to miss: October 7, 2026 is the deadline both to exclude yourself and to object. The Court granted preliminary approval and has scheduled a final approval hearing for November 6, 2026 at 9:00 a.m. Central Time in Fayetteville, Arkansas — after claims close. No final approval order has been entered and no payment date had been announced as of August 24, 2026.

What Changed Recently?

The Circuit Court for Washington County, Arkansas authorized notice to the class, which opened the claim window and put the November 6, 2026 final approval hearing on the calendar. The case is In re Highlands Oncology Group Data Breach Litigation, Case No. 72CV-25-3420.

The lawsuit alleges that during a June 2025 targeted cyberattack on Highlands Oncology's computer systems, certain files containing private information were accessed. According to the court-approved Notice, those files may have contained names, dates of birth, Social Security numbers, driver's license and state identification numbers, passport numbers, credit and debit card numbers, financial account numbers, medical treatment information, medical record numbers, patient account numbers, and health insurance policy information.

That combination is what makes this settlement's monitoring benefit unusual. Most data breach settlements offer credit monitoring, which watches for new accounts opened in your name. Here the exposure includes medical record numbers and health insurance policy information, so the settlement offers medical data monitoring instead — a different product aimed at a different kind of fraud.

Highlands Oncology denies that it did anything wrong, and the Court has not decided who is right. The parties agreed to settle to avoid the costs, risks, disruptions and uncertainties of continuing the case. Healthcare providers have produced a steady run of these settlements — the Tift Regional Health System settlement and the MCNA Dental settlement both turned on the same kind of patient-record exposure.

Who Qualifies?

The Court defined the Class as all individuals residing in the United States whose Private Information was compromised in the Data Breach on or around June 2025. This is a nationwide class rather than an Arkansas-only one — what matters is that your information was in the affected files, not where you live.

The Notice states that Highlands Oncology's records indicate who the class members are, and that a class member may also have received an earlier notice directly from Highlands Oncology at the time of the incident.

The class excludes only three groups, which is a narrower carve-out than most breach settlements:

  • All persons who are directors and officers of Highlands Oncology;
  • Governmental entities; and
  • The Judge assigned to the case, that Judge's immediate family, and Court staff.

How Much Can You Get?

The benefits come in two parts, and the relationship between them is the single most misread thing on pages like this: the monitoring and the cash are additive. The Notice states that all Settlement Class Members may claim Medical Data Monitoring and one of the two Cash Payment options. The choice is only between the two cash tiers.

  • Medical Data Monitoring. Three years of CyEx Medical Shield Complete, which carries $1 million of medical identity theft insurance and monitors for healthcare insurance ID exposure, Medical Record Number exposure, and unauthorized Health Savings Account spending. If something suspicious surfaces, the service provides access to a fraud resolution agent.
