Why is There a Class Action Settlement?

The Plaintiff filed the lawsuit alleging that MobilityWare’s gaming apps collect personal information about the users without consent and track online behavior to sell to third parties and profile for targeted advertising. Defendants deny the allegations and any wrongdoing. Nonetheless, they have agreed to settle this lawsuit to avoid the cost and uncertainty of litigation.

The Court has not decided in favor of either side. The Plaintiff and her attorneys assert that the proposed Settlement is in the best interests of the Class because it provides an appropriate recovery now while avoiding the risk, expense, and delay of pursuing a lawsuit through trial and any appeals. There would be no guarantee of success for either side if the lawsuit were pursued through trial and any appeals.

This amount will be sent to you by check unless you promptly contact the Settlement Administrator at info@valuefinancereposettlement.com to request one of the other available payment methods.
  • Credit Reporting Relief : Value Finance will request that the credit reporting agencies update your credit report to remove any reference to the auto loan account with Value Finance. • Elimination of Disputed Deficiency Balances : If you have been advised by Value Finance that there is a shortfall after the auction of your repossessed vehicle, that balance claimed due is called a “Deficiency” or “Deficiency Balance.” Your Deficiency Balance on your vehicle loan will be eliminated as a result of this settlement. • Non-Active Account Members: Those who do not have an account with the Piedmont 401(k) Plan with a balance greater than $0 as of the date of the Final Approval Order.

The Net Settlement Fund, which is the settlement amount minus administrative expenses, attorneys' fees, and any case contribution awards to the plaintiffs, will be divided among the class members.

Each member's share will be calculated by dividing their weighted average account balance by the total weighted average of Plan assets over the class period, then multiplying by the Net Settlement Fund. For example, if the Net Settlement Fund is $1,500,000 and the total weighted average of Plan assets is $10,000,000, a member with a weighted average account balance of $100,000 would receive:

Oracle America $25M Settlement for Pay Discrimination Claims

Update: The settlement was granted final approval in October 2024. The settlement administrator began issuing payments to eligible class members on Nov. 7, 2024.

If you are a woman who worked for Oracle America, Inc. in California between June 16, 2013, and April 22, 2024, you may be eligible to claim an award from a class action settlement.

Oracle America, Inc. has agreed to pay $25,000,000 to settle a class action lawsuit for alleged violations of California's Equal Pay Act and Unfair Competition Law. The lawsuit claims that Oracle unlawfully paid women less than men for performing substantially similar work and had a practice of relying on prior pay to determine starting pay, which allegedly had a disparate impact on women.

Who Can Claim an Award?

The settlement class includes:

  • Who : all women employed by Oracle in California
  • Which Roles : Information Technology, Product Development, and Support job functions
  • Excluding : campus hires and managerial positions
  • When : from June 16, 2013 through April 22, 2024.

Those who fall within this definition are members of the settlement class and eligible to claim an award.

Those who received a notice via mailed, it is because they were listed in Oracle’s records as a Settlement Class Member.

What Awards Can Class Members Claim?

The total settlement fund is $25,000,000. After deducting costs for settlement administration, attorneys' fees, litigation and expert costs, and service awards to the named plaintiffs, the remaining amount will be distributed to class members.

The net settlement fund, approximately $15,011,600, will be allocated to class members based on their total compensation earned during the class period. The formula for calculating individual awards is:

  • Pro Rata Share : Total Compensation Earned by Settlement Class Member ÷ Aggregate Total Compensation Earned by All Settlement Class Members

For example, if a class member earned $500,000 over three years and the aggregate total compensation for all class members is $2 billion, their share of the net settlement amount would be 0.025%. If the net settlement fund is $15 million, the class member's award would be $3,750. Note this is an hypothetical example, not reflective of actual figures, and settlement awards will vary.

If you own property through which the Las Flores Pipeline System (formerly known as Plains’ Line 901 and Line 903) passes, you may be eligible to claim between $50,000 and $230,000 from a class action settlement.

Pacific Pipeline Company (PPC) and Sable Offshore Corp. have agreed to pay $70,000,000 to settle a class action lawsuit for alleged failure to use, operate, and maintain the Pipeline for many years, leading to the termination of Easements.

Assuming no Properties opt out of the Settlement, Class Counsel estimate that all Class Properties will receive at least $50,150, with an estimated median payment of approximately $90,000 and an estimated average payment of $230,000.

  • Licensed Psychiatric Technician

PAGA members include those employed from July 7, 2009, through April 10, 2013 at the same facilities and the same positions as above.

How much can class members get?

Class members will receive payments based on the number of compensable shifts and the positions held. The Net Settlement Amount will be divided among class members using the following formula:

  • Mental Health Workers and Behavioral Health Specialists: Value of 1.0 per shift.
  • Licensed Vocational Nurses and Licensed Psychiatric Technicians: Value of 1.5 per shift.
  • Registered Nurses: Value of 2.5 per shift.

The total compensable shifts for all class members will be divided by the Net Settlement Amount to determine each class member's payment ratio. This ratio will then be multiplied by the Net Settlement Amount to determine the individual settlement payment.

PAGA members will receive a pro rata share of the $25,000 allocated for PAGA payments based on the number of pay periods worked during the PAGA period.

Example Calculation

Suppose the Net Settlement Amount is $3,445,259 and there are 350,467 compensable shifts in total. If a Registered Nurse worked 200 shifts, the calculation would be as follows:

  • Calculate the value of the shifts: 200 shifts \* 2.5 = 500.
  • Determine the payment ratio: 500 / 350,467 = 0.001427.
  • Calculate the individual payment: 0.001427 \* $3,445,259 ≈ $4,918.68.

PNC Bank settles MLO class action for $11.85 million (CA)

If you were employed by PNC Bank, N.A. in California as a mortgage loan officer between June 28, 2014, and June 30, 2019, you may be eligible to claim a portion of an $11,850,000 class action settlement .

PNC Bank, N.A. has agreed to pay $11,850,000 to settle a class action lawsuit for alleged violations of California labor laws, including failure to provide paid rest periods and accurate wage statements.

Who are the class members?

Class members are those who worked as Mortgage Loan Officers for PNC Bank in California during the class period from June 28, 2014, to June 30, 2019. To qualify as a class member, you must:

  • Have been employed by PNC Bank as an MLO in California during the specified period.
  • Not have opted out of the class settlement.

The settlement also covers claims during the settlement period from June 28, 2014, through June 1, 2023.

How much can class members get?

The settlement provides a gross settlement fund of $11,850,000, which will be distributed among class members based on their compensation earned during the class period. Class members will receive payments calculated using a point system that considers the length of employment and compensation earned.

  • Base Payment : Class members employed from January 4, 2017, to June 1, 2023, will receive a base payment calculated by multiplying their working percentage by $4,000.
  • Allocation Points : Additional payments will be based on allocation points, with different values assigned for compensation earned during various periods. For example, from June 28, 2014, to January 4, 2017, each dollar of compensation earns 0.15 points. The total net settlement fund, after deductions, will be divided by the total allocation points to determine the dollar value of each point.

Example Calculation

Let's assume a class member worked for PNC Bank from January 2015 to June 2019 and earned $50,000 in compensation during this period. Here’s how the calculation would work:

  • Base Payment : If they worked from January 4, 2017, to June 1, 2023, their working percentage would be calculated based on the months worked during this period. Suppose they worked 24 months out of the 77 months, their working percentage would be 24/77. Therefore, their base payment would be (24/77) \* $4,000 = $1,246.75.
  • For the period from June 28, 2014, to January 4, 2017, they would earn 0.15 points per dollar of compensation. If they earned $30,000 during this period, they would get 30,000 \* 0.15 = 4,500 points.
  • For the period from January 5, 2017, to June 30, 2019, they would earn 1.0 points per dollar of compensation. If they earned $20,000 during this period, they would get 20,000 \* 1.0 = 20,000 points.
  • Total Points : The total points would be 4,500 + 20,000 = 24,500 points.
  • Point Value : If the adjusted net settlement fund is $7,296,071.38 and the total points for all class members is 60,000,000, the point value would be $7,296,071.38 / 60,000,000 = $0.12 per point.
  • Total Payment : The total payment would be the base payment plus the allocation points value, which is $1,246.75 + (24,500 \* $0.12) = $1,246.75 + $2,940 = $4,186.75.
