Current Status
Claims are open. The deadline is November 24, 2026, according to the official settlement website, which does not list a time zone. The Circuit Court of St. Louis County entered its final approval order on May 27, 2026, so the settlement is final. No payment date had been announced as of October 21, 2026.
What Changed Recently?
The case, Brimmer v. City of Overland, was filed in St. Louis County circuit court on July 28, 2017, and the court certified it as a class action on September 10, 2021. The lawsuit alleged that special deterrent fees collected from municipal court defendants as part of plea agreements, and later ordered as a condition of probation, were not authorized by Missouri law and should be returned.
The parties told the court on January 28, 2026 that they had reached a settlement. The court granted preliminary approval on February 25, 2026 and final approval on May 27, 2026. The final order says no class member opted out or objected. The City of Overland denies the allegations and did not admit liability.
Who Qualifies?
The settlement agreement defines the class as every person who was ordered by the Overland Municipal Court to pay a special deterrent fee and who paid it between August 4, 2012 and September 10, 2021. The court that ordered these payments is the Overland Municipal Division of the Associate Circuit Court of St. Louis County.
The class is small. The final approval order puts it at approximately 344 people, and the settlement website posts a searchable list of people the City's records show paid the fee. Class members who did not opt out by April 13, 2026 are bound by the settlement.
How Much Can You Get?
Each class member who files a valid claim receives a flat $80, paid by check. The amount is not pro rata, so it does not shrink or grow with the number of claims.
The settlement agreement sets aside a class compensation fund of $26,240. Under the agreement, money still unclaimed six months after final approval goes back to the City rather than being redistributed. The City pays the other costs separately: $15,000 in attorneys' fees for class counsel, Schultz Law Group, a $2,500 incentive award to the named plaintiff, and the administrator's costs.
What Proof or Notice ID Is Required?
The online claim form asks for a Claimant ID and the claimant's last name before it opens. The Claimant ID comes from the settlement notice. Under the agreement, the City mailed postcard notice to class members after preliminary approval and was to mail a second written notice with claim instructions within 10 days of final approval. Claimants must also verify their identity as class members. No receipts are required.
The settlement website's Contact Us page explains how to reach Atticus Administration for anyone on the class list who no longer has the notice.
What Is the Deadline?
Claims must be submitted by November 24, 2026. The official website gives only the date, not a time of day or time zone.
The final approval order describes a claim window of six months from final approval, after which no further applications are accepted. The administrator lists November 24, 2026 as the claim filing deadline.
How Do You Take Action?
Claims are filed on the official Overland settlement website. The Claim Form Login page asks for the Claimant ID and last name, then opens the claim form. If a last name contains an apostrophe, the site asks for it to be left out.
What Happens Next?
The claim window closes November 24, 2026. The settlement website does not give a date for mailing the $80 checks, and no payment date had been announced as of October 21, 2026.
