Class action settlement
Costa Del Mar $21.75M Sunglasses Repair Fee Settlement
Florida consumers who bought Costa sunglasses or paid a repair fee may qualify to claim a cash payment from a $21.75 million class action settlement.
Who qualifies and how to claim
Costa Del Mar agreed to a $21.75 million class action settlement to resolve claims it charged unfair fees to repair sunglasses despite promising to do so for a “nominal fee.”
The Costa Del Mar settlement covers Florida residents who purchased non-prescription, non-promotional Costa sunglasses for personal use and fall into one of two groups: (1) the Purchase Class, which includes those who purchased sunglasses between July 28, 2013, and Jan. 31, 2018, and (2) the Repair Class, which includes those who purchased sunglasses on or before Jan. 31, 2018, and paid Costa to replace damaged components between July 28, 2012, and Jan. 26, 2025.
According to the class action lawsuit, Costa promised to repair sunglasses for a “nominal fee.” In reality, the company allegedly charged consumers more than a nominal fee to repair sunglasses damaged by accident, normal wear and tear or misuse without disclosing the repair costs before customers mailed in their sunglasses.
Costa Del Mar is a sunglasses company that sells a variety of sunglasses, including those designed for fishing, boating and other water sports.
Costa has not admitted any wrongdoing but agreed to a $21.75 million class action settlement to resolve the allegations.
Under the terms of the Costa Del Mar settlement, class members can receive a cash payment. Repair Class members can receive a proportional share of the net settlement fund based on the number of repairs they had done. Purchase Class members can receive a proportional share of the net settlement fund based on the number of purchases they made.
The deadline for exclusion and objection is Jan. 19, 2027.
The final approval hearing for the Costa Del Mar settlement is scheduled for March 23, 2027.
To receive a settlement payment, Purchase Class members must submit a valid claim form by Jan. 11, 2027. Repair Class members do not need to file a claim form.
The class action settlement benefits Florida residents who purchased non-prescription, non-promotional Costa sunglasses between July 28, 2013, and Jan. 31, 2018 (Purchase Class) or who were charged a fee by Costa between July 28, 2012, and Jan. 26, 2025, to replace damaged components of their non-prescription, non-promotional Costa sunglasses (Repair Class).
Repair Class members do not need to submit a claim form to receive a cash payment. Purchase Class members must submit proof of purchase, such as a receipt, work order, credit card statement or other documentation, for more than five qualifying purchases.
