What Changed Recently?
Magistrate Judge David L. Horan of the U.S. District Court for the Northern District of Texas preliminarily approved the $850,000 settlement in Bond v. Folsom Insurance Agency on September 15, 2026, which opened the claim process. The order came after an in-person hearing on July 21, 2026, at which the plaintiff added an expert report on Folsom’s calling records and a copy of Folsom’s insurance policy to the record. The court appointed Angeion Group as claims administrator and set October 15, 2026 as the date by which notice had to go out to the class.
The lawsuit was filed on February 29, 2024. The complaint alleges that Folsom Insurance Agency, a Texas agency that sells trucking insurance, used a prerecorded telemarketing message to offer down payment assistance on insurance to people whose trucking authority was not yet active, and that it sent those messages to cell phones without the prior express written consent the Telephone Consumer Protection Act requires. Folsom denies any wrongdoing or liability and denies violating the TCPA. The parties mediated the case in December 2025 and settled to avoid the cost and risk of further litigation; the court has not decided whether any law was broken.
Who Qualifies?
The settlement class covers everyone in the United States whose cell phone number, or another number charged for incoming calls, received a call or voicemail placed by Cody Folsom or Folsom Insurance Agency, LLC (or an agent acting for them) between February 29, 2020 and September 15, 2026, using a prerecorded message identical or substantially similar to the one sent to the named plaintiff.
There is a second condition that narrows the class considerably: the number has to be one of the 41,719 phone numbers identified in the expert report of Aaron Woolfson, who analyzed the call logs Folsom produced during discovery. Someone who remembers a Folsom voicemail but whose number is not on that list is not a class member. The claim form also asks each claimant to attest, under penalty of perjury, that Folsom called or left a voicemail on their cell phone using a prerecorded voice even though they had no relationship with the agency.
How Much Can You Get?
The notice estimates that each valid claimant will receive between $125 and $200. Every approved claimant gets an equal share of what remains of the $850,000 fund after three deductions, all subject to court approval: notice and administration costs, which Angeion estimated at about $77,589; attorneys’ fees of no more than one-third of the fund; and litigation costs of no more than $35,000.
Because the fund is split equally, the final amount depends on how many valid claims come in. As an illustration only: if fees and costs are approved at their caps, roughly $454,000 would be left for claimants, and the $125 to $200 range corresponds to roughly 2,300 to 3,600 valid claims out of the 41,719 numbers on the class list. More claims would mean smaller payments, and fewer claims larger ones. The pro rata estimate is not a guarantee.
What Proof or Notice ID Is Required?
No receipts or phone bills are required, but filing online requires the Notice ID and Confirmation Code printed on the personalized notice mailed or emailed to class members. The online claim form opens directly on a login screen for those two codes and offers no option for people who did not receive a notice.
