Privacy notice

The short version: we don't save your searches, Google Analytics counts visits unless you choose "Essential only", Google advertising cookies are used only if you choose "Accept all", and if you subscribe we keep just your email address, encrypted, until you unsubscribe.

Who runs this site

Passive Action is run by the operator of Passive Action, the "controller" of the personal data described here. For any privacy question or request, email help@passiveaction.org.

We are an independent directory of class action settlements. We are not a law firm, and we are not affiliated with any court, settlement administrator or law firm.

Online news analysis

Each settlement has an "Analyze online news & media" button. When you use it, we send that settlement's public details (its title, description and official website link, and nothing about you) to Anthropic's Claude API in the United States, which searches the web and writes a short summary. Summaries are kept for about a day and shown to anyone who asks about the same settlement. They are generated automatically, can be wrong or out of date, and are not legal advice.

Map and your location

The map, the first view of the home page, shows settlements filed near you. To centre it, our server sends your IP address to an IP location service, ipwho.is, or geojs.io if ipwho.is doesn't answer. The service replies with an approximate city and its coordinates. We use that only to place the map, and we don't store your IP address. The lookup happens only when the map is shown, not in the cards or list views or on any other page.

If you press "Use my location", the map asks your browser for your exact location. Your browser asks you first, and you can say no. If you allow it, your position stays on the page: distances are worked out in your browser, and your position is never sent to us. You can also drag the marker to any spot instead.

The map images come from Esri, and the map software comes from cdnjs, which Cloudflare runs. Like any service your browser loads files from, they see your IP address when it fetches them.

Email updates

If you subscribe on a settlement's page, we email you about that settlement, such as deadline changes and payment news. If you also tick "new settlements", we tell you when new ones open. Every email has a one-click unsubscribe link. Unsubscribing deletes your email address from our records, and we ask our email provider to delete it too.

To send these emails, your address is passed to the customer relationship and email service we use. That service acts only on our instructions.

Membership

Membership is coming soon. Nobody can join or pay until it opens; you can join the waitlist instead. Until then, email updates are free for everyone. The rest of this section describes how membership works once it is open.

Browsing is free and needs no account. Memberships start at $5 a month: Basic adds settlement notifications and monitoring, and Plus also adds the "Analyze online news & media" button and "Help me with this application". Plans are monthly or yearly, can start with a free trial, and Plus can also be bought for life with one payment. A membership is never required: filing a claim is always free, and we never file anything for you.

Payment is taken by Stripe, under its own privacy policy, either on Stripe's own checkout page or in a secure Stripe window that opens on this site. We never see your card number. Stripe tells us the email address you entered, a customer number it assigns, which plan you chose, and whether it is in a trial, active, past due, cancelled or paid for life; that is all we keep, and the email address is stored encrypted like a subscriber's. Cancelling, switching plans, changing your card and downloading invoices happen on Stripe's billing page, reached from the membership page.

The secure Stripe window loads Stripe's script from js.stripe.com only when you start a payment on this site. Stripe then sets its own fraud-prevention cookies, __stripe_mid and __stripe_sid, and sees your IP address, as described in Stripe's privacy policy.

Your browser gets a cookie, pa_member, that tells us which member you are. It is set only when you join or sign in, lasts a year or until you sign out, and is never used for tracking or advertising. To use your membership on another device, ask for a sign-in link on the membership page: we email a link that works once and expires after 30 minutes.

After you have looked at a few pages, a small card may invite you to become a member (while membership is coming soon, to join the waitlist), at most once a month. To know when, your browser keeps a page count and the date it last showed the card, under pa_invite in its local storage. That stays on your device and is never sent to us.

If you subscribe to updates on a settlement as a member, that works as described under Email updates. When your membership ends, we keep your customer number and subscription status for as long as bookkeeping and tax rules require, then delete them. To have everything deleted sooner, email help@passiveaction.org.

Membership waitlist

While membership is coming soon, you can leave your email address on the membership page or in the membership popup. That is all the waitlist asks for. We keep the address encrypted, use it only to email you once when membership opens, and don't add you to any other list, send it to our mailing service or share it with anyone. After that email the address is deleted from the waitlist. To be taken off sooner, email help@passiveaction.org.

Contact and suggestion box

The box on the contact page and the membership page asks for nothing but your message: no name, no email address. We don't record your IP address with it. The message is emailed to the person who runs the site and kept, encrypted, on our server for up to a year in case that email goes astray, then deleted. If you want a reply, write your email address in the message; we use it only to answer you.

Pages with the box set a security cookie, pa_csrf. It holds a random value and nothing about you, and lets us check that a message really was sent from this site and not forged by another one. While you type, your browser keeps a draft in this tab's session storage (pa_contact_draft) so a failed send doesn't lose it; that never leaves your device until you press Send, and it is cleared when the message goes through or you close the tab.

Supporting the site

The "Donate" button opens a payment page at donate.stripe.com, run by an outside payment provider, not by us. Anything you give there is a voluntary contribution toward hosting and data. It is never required, it is not a fee, and it has nothing to do with any claim: filing a claim is always free, and we never file anything for you.

The provider handles your card or account details on its own site, under its own privacy policy, and we never see your card number. It passes us the amount, your email address and, depending on how you pay, your name and billing ZIP code. We keep those only to send a receipt or a thank-you and to keep our accounts, and we don't add you to any mailing list. The payment page may set its own cookies; none of them are set on this site.

Cookies

Every page loads Google Tag Manager in Google's consent mode. Google Analytics cookies are on by default so we can count visits; choosing "Essential only" switches them off. Advertising cookies stay off until you choose "Accept all". Then Google advertising (Google AdSense, and Google Ads remarketing) can use cookies to show, personalize and measure ads. If your browser sends a Global Privacy Control signal, we keep advertising cookies off. Google may process this data outside your country, including in the United States. Google explains how it uses this data at policies.google.com/technologies/partner-sites.

Your rights

You can ask to see, correct, export or delete the personal data we hold about you, object to how we use it, or withdraw your consent at any time. Withdrawing consent doesn't affect anything we did before. Email help@passiveaction.org and we'll reply within one month.

If you are in the EU, the UK or the EEA, you can also complain to your local data protection authority. If you are a California resident, you have similar rights under the CCPA. We don't sell your personal information. If you choose "Accept all", Google's advertising cookies may be used for personalized ads and remarketing, which California law can treat as "sharing". To opt out at any time, use and choose "Essential only".

Where the settlement information comes from

Everything shown about a settlement is public. We compile it from court-approved settlement websites and from these public listing sites, and we refresh it automatically:

Details can change or be wrong at the source, so always confirm eligibility and deadlines on the official settlement website.

Changes to this notice

If we change how we handle personal data, we'll update this page and the date at the top. If a change affects what you agreed to when subscribing, we'll ask you again.
