What Changed Recently?
The Circuit Court for Miami-Dade County, Florida preliminarily approved the settlement in Carter v. Teleflora LLC on August 26, 2026, two months after the case was filed. The lawsuit alleges that Teleflora sent telemarketing text messages to cell phone numbers on the National Do Not Call Registry without consent, in violation of the federal Telephone Consumer Protection Act and the Virginia Telephone Privacy Protection Act, including to people whose numbers had been reassigned from earlier subscribers. Teleflora denies all of the claims and is settling to avoid the cost and uncertainty of litigation.
Who Qualifies?
The class covers people throughout the United States who did not give their phone number to Teleflora LLC, who received more than one Teleflora promotional text message within a 12-month period, and whose residential or cell number had been on the National Do Not Call Registry for at least 30 days before Teleflora sent at least two of those texts. The class period runs from May 9, 2021 through August 26, 2026. The notice estimates about 23,844 phone numbers are in the class.
How Much Can You Get?
Each approved claim pays up to $251, minus the class member's share of administration costs and attorneys' fees. Under the settlement agreement, that share is calculated by adding the fee award and administration costs, which are capped at $61,446, and dividing the total by the number of class members, whether or not they file. Class counsel will ask for fees of up to one-third of $6 million plus up to $20,000 in expenses. If the full fee is awarded, OCA estimates each class member's share of fees and costs at about $86, which would leave roughly $165 per approved claim. That figure is an estimate, and the actual amount depends on what the court approves.
The $6 million is a ceiling, not a fund that will be paid out in full: under the settlement agreement, money not used for approved claims, administration and fees stays with Teleflora. Teleflora will also subscribe to the FCC's Reassigned Numbers Database for its recurring marketing texts within 90 days of final approval. Service awards for the plaintiffs are paid by Teleflora separately from the settlement sum.
What Proof or Notice ID Is Required?
The online claim form opens only with the Notice ID and Confirmation Code from the notice, and the paper claim form also requires a claimant identification number. Under the settlement agreement, a claim without a valid claim ID cannot be approved. The notice says people who did not receive a notice may still be in the class if their number appears in the texting records, and it directs them to contact the settlement administrator through the settlement website.
No receipts are needed. Claimants list the phone number or numbers that received the texts, up to three, and sign an affirmation. Only one claim per class member per phone number is validated.
What Is the Deadline?
Online claims are due by 11:59 p.m. Pacific Time on November 17, 2026, and mailed claims must be postmarked by that date. Exclusion requests must be mailed and postmarked by November 17, 2026; the notice says they cannot be made by phone, email or on the website. Objections must also be filed or postmarked by November 17, 2026.
How Do You Take Action?
Claims are filed through the official Teleflora settlement website, run by the administrator Angeion Group, which also has a printable claim form for mailing. Payments are made by paper check, and checks are void after 120 days.
