Current Status
Claims are open. Claim forms are due November 24, 2026, which is also the deadline to exclude yourself or object; the notice gives no time of day, so file early. The Court granted preliminary approval on August 14, 2026 and has scheduled the final approval hearing for December 3, 2026 at 10:00 a.m. No final approval order has been entered and no payment date had been announced as of September 24, 2026.
What Changed Recently?
Judge P. Casey Pitts of the U.S. District Court for the Northern District of California granted preliminary approval on August 14, 2026, which opened the claim period. The case is Vasquez v. Venetian Las Vegas Gaming, LLC, No. 5:25-cv-07934-PCP. Before approving, the Court entered an order on June 25, 2026 requiring the parties to file additional disclosures about the proposed settlement, the day after the motion for preliminary approval was filed.
The complaint, filed September 17, 2025, alleges that venetianlasvegas.com embedded tracking tools from Heap, Google and Meta that intercepted visitors' communications with the site without their consent, in violation of the California Invasion of Privacy Act (Penal Code sections 631 and 632), and that the site disclosed hotel guest record information in violation of California Civil Code section 53.5. Venetian denies the claims and denies violating any law, and the Court has not decided who is right. The settlement avoids the cost and uncertainty of continuing the case.
Who Qualifies?
There are two classes. Both are limited to California residents who were in California when they used the site, during the period from September 18, 2024 through March 16, 2026:
- Booking Class. Those who made a reservation for a Venetian hotel stay through venetianlasvegas.com — about 35,159 people.
- Browsing Class. Those who accessed or navigated venetianlasvegas.com — about 996,705 people.
The location requirement matters. Living in California is not enough on its own; the booking or browsing has to have happened while you were in the state. The two definitions also overlap, since anyone who booked on the site necessarily visited it. The claim form on the official settlement website is where to select the class or classes you belong to.
How Much Can You Get?
The $1,600,000 settlement is non-reversionary, so none of it goes back to Venetian. It is split into two separate funds:
- Booking Settlement Fund — $931,713.50. The settlement website estimates a net payment of about $71.39 per valid Booking Class claimant, assuming 20% of the class files.
- Browsing Settlement Fund — $668,286.50. The settlement website estimates a net payment of about $3.60 per valid Browsing Class claimant, assuming 10% of the class files.
Each fund is divided in equal shares among its own valid claimants after court-approved attorneys' fees and costs, settlement administration costs and any service award are paid. These figures are estimates, not promises. If more people file than the assumed rate, each share goes down; if fewer file, each share goes up.
What Proof or Notice ID Is Required?
The settlement does not describe any requirement for receipts, booking confirmations or browsing records. The class definitions turn on where you lived, where you were and what you did on the site, and claimants identify themselves on the claim form. If you received an emailed or mailed notice with an identification number, have it ready when you file.
What Is the Deadline?
November 24, 2026 is the single deadline for three things: submitting a claim form, asking to be excluded from the settlement, and objecting to it. The notice gives the date only, without a time of day or time zone. Mailed submissions should be sent early enough to meet the deadline stated on the form.
